Yes. The old labor is valid for 180 days after July 16th.
If your lawyer can establish that A is still alive in some form, then this is possible. The new avatar of A (B or AB) can apply for 140.

Hi,
I have filed for my I-485 application (based on a approved I-140) in July 2007. At that time I also filed for another I-140 based on a substitute labor that I got which had a earlier priority date.
Now that new I-140 that I filed with substitute labor is approved. I am looking at possibility how I can use this new I-140.
I heard there is something called changing underlying I-140 application. Can someone explain this and tell me how I can use it in my case please.

Dear all,
Myself and my husband both have approved I-797 for H1B from different US companies.
I went for my stamping to US embassy and they asked for more evidence regarding the US company and my case is currently pending with them with all my documents ( passport, I797, marriage certificate, etc).
Now my US company is not able to get a job letter for me.
Meanwhile my husband is planning to go for his stamping. He has good evidence to support his case.
My questions are -
1.) How can I retrieve all my documents from US embassy without affecting my passport and my H1 case?
2.) If I am able to retrieve all the documents safely, can I apply for H4 with my husband`s H1 stamping?
3.) Will they create problem for issuing H4 to me because of my pending H1b case?
4.) With H4 visa and I-797 approval notice, can I start working in US ?
5.) What will be the best way out of this situation without affecting our working visas ?
Please reply if you know anything.

There are instructions on your original letter from the IRS telling you that your application for an ITIN number was granted. I believe you need a copy of that letter and a copy of your ssn to send back to them. If you cant find instructions send me a private message and I will pull my letter out for you.

My employer(hospital)filed for the PERM processing and paid the fees for it.It was subsequently approved with an audit.I filed for the I-140 in May 2008.The lawyer who was recommended by the employer did not give me the receipt number,nor the receipt.I was just told that it is pending approval.What are other people's experiences do you usually get a copy of the receipt?I was expecting to get it as I paid for the I-140 filing?I just want it so that I can keep tracking it on the uscis website.

My story:
In my 2 work exp.letters submitted to CIS, I break down the number of months I was working with company A with 2 different positions and stated my duties & responsibilities. I started as an electrical technician from 06/'07 - 01/'98 (7mos.) and move to Sales Engineer position from 02/'98 - 09/'98 (7mos.) so that a total of 14 mos. CIS only counted the electrical technician experience since my labor application position is electrical technician. However, the position of sales engineer, also entails the work of an electrical technician. meaning sales works is an added duties for the technicain job.
Moreover, my second letter, company B with a job title of Technical Trainee was totally disregarded. Where in fact, my work is actualy training a would be
"electrical technician". Now I just need to find ways to justify that to CIS. I dont know how to start though...could anybody help me here????

My I140 was filed 10/01/2007 and it got approved Jun 4th,2008 I think the processing dates are little misleading.

I am an Indian, currently working in Saudi Arabia. Just paid my IV fee to NVC, and waiting for Package-3. As far I understand regards to Police Clearance Certificate, I need to get Police Clearance from
1. Indian embassy from Saudi Arabia (as Saudi PCC are not available for third country citizen residing in the kingdom) and
2. Local and District police stations from India, where I stayed more than 06 months.
As per Indian embassy web site to apply for PCC, need Letter from Embassy which has asked for Police Clearance Certificate (where from I can get this letter??)
I heard from my friends, its very hard to get PCC form local and District police office in India for NRI�s (anybody experienced similar situation, please just guide us/ is it take time?? )
One more doubt , is it possible get police clearance without Package-3 (? Any special form for PCC in Package-3)
