One of the comments on my post earlier today about the killed Border Patrol agent seemed pretty harsh - accusing most BP agents of being restrictionists with bad motives. I still think that's harsh and most Border Patrol agents are honestly out to do the necessary job of protecting our country's borders. But the timing of a major scandal involving Customs and Border Patrol certainly will make many people question just who the agency is hiring. I am currently working on EAD (thru 485), graduated in August 07, applying for H1B (first time) in April 08, my questions
1. Any effect on my AOS.
2. Can I start working without going ouf of the country once my H1B is approved on Oct 1st 2008.

My wife is laid off and her company is going to cancel her H1B soon. h1 petition is getting expired on Oct,2009. now I am going to apply for COS to h4. If she wants get H1 status after one year can she use the same petition for H1 transfer?. or she has to apply a new H1?.

She has to apply for COS again from H4 to H1. It will not be subjected to the cap if she had H1 within last six years at the tme applying COS to H1

Can people post experiences on turnaround time for getting medical test documents back from the doctor? I have heard 2-3 days after initial appointment, but the doctor's offices I have called say 7-10 business days. Also, I have heard that some doctor's are faster than others. Is this true?

I am on 8th year of my H-1B, expiring on July-2008.
I am on EB3 Nebraska, PD 07/2003.
I-140 pending � RFE on Education (3 years degree) replied on December-2007
EAD approved on September-2007.
I485 aplied on july-2-2007
Just got an email from Cris that my I485 was denied. I don�t know the reason.
My I140 is still pending � almost 4 months after my attorney replied the I140 RFE.
Today I am writing this in order to understand my available options and strategy to this situation.
I have less than 2 months on H-1(b).
What are my options?
Anybody in the same situation?

I am in the process of going full time with my client.
I have my I-485 Filed in July 2007 & have EAD & AP
I am not in a position to use EAD as I got married after I filed for I-485. I have to stay on H1B to maintain my wife's H4 status.
my Client's Attorney is filing for H1B transfer and is suggesting that I can use EAD to start working as soon as he files for H1B transfer.
My understanding is I will loose H1 status if I use EAD, hence H4 will be invalid.
Was anybody in a similar situation ?
I don't want to take a risk by using EAD and my wife loosing H4 status.
Please advice

I need some clarification. One of my friend confued me.:confused:
My I-485 is filed (I-140 is already approved) by my lawyer.
I am traveling in Sep end returning in Oct End.
I have my H1-B extension with me and need to get it stamped in India.
As per my lawyer, she will file for EAD and AP after I come back. I am not sure what she ment then about the she has filed my application in July.
As per her there is no issue as she will file my EAD/AP after I come back.
Will this travel be an issue in my stamping in India and/or getting back in the US after stamping?
Please advice.
