My friend Margaret Stock has prepared an excellent report for the Immigration Policy Center entitled ESSENTIAL TO THE FIGHT: IMMIGRANTS IN THE MILITARY EIGHT YEARS AFTER 9/11. Margaret, an officer in the army and the undisputed leading national expert on immigration and the American armed forces, notes a number of key findings in her report: As of June 30, 2009, there were 114,601 foreign-born individuals serving in the armed forces, representing 7.91 percent of the 1.4 million military personnel on active duty. I am on H1-B. I filed I-485, I-131 and I-765 in August 2007 under EB3 (ROW). I got married in Sept 2007 but my wife is still in home country due to J-1 2 year HRR. Her 2 years are up in Jan 15, 2008 and she plans to join me on H4.
1. Does my company or I need to do anything for her to apply for a visa at the consulate? Does she take a copy of my H1-B approval marriage certificate and that's it?
2. When she comes the US at the end of January we plan on filing I-485 for her based on my application pending. Can she file for AP and EAD at the same time? Would she be able to work on EAD if it gets approved?
3. I got a letter in the mail today that I have to appear for biometrics on Nov 07, 2007. Does it mean that after my biometrics are taken my GC could get approved right away, even though EB3-ROW is no longer current?
4. After my I-485 has been pending for 180 days, does it mean I could take a similar job anywhere?

This incident opened my eyes and prodded me to move my fat ass to do something about this.
I just made my first contribution of $100 to IV.
Gandhi once said "Make your contribution, however insignificant you think it is. In reality, your contribution makes a huge difference".
Like he said, our little acts when combined become a formidable act and can accomplish a lot. I would suggest others make contributions too - especially now when everyone is excited - before you get back to the usual reticent state. let us not try to ride piggyback on some else's efforts.

My situation is tricky here. I would really appreciate any inputs.
My six years validity for H-1 B will be complete in Mid Dec 2007. I filed my Labor on March 5th in Atlanta. As you know the ATLANTA center is really really slow and I am still waiting on my Labor approval decision. I thought of applying 140 through Premium Processing. Now USCIS suspended premium processing for 140s. My question is:
Whay will be my situation if my Labor gets approved and 140 is pending as of dec 2007 as the LC is filed with less than 365 days remaining on H1 validity? Will I be out of status or can I apply for 7th year extension.
Please guide me through the process and any scenarios. Thank you in advance.

The storyline continues. Last year, 13,500 regular H-1B applications were counted in the first week and 5,600 advanced degree applications. This year 5,900 regular applications were received in the first week and 4,500 advanced degree petitions. USCIS just reported that in the second week of counting, 7,100 regular cases were receipted and 5,100 advanced degree applications. That's roughly the typical weekly usage we saw last year and if the pace doesn't change much, the cap will potentially be hit one to two months later than for FY2011. Hi- When I started off with the green card process, I had not idea about what most of the things meant. I joined a very reputable Fortune 500 company in 2006 (the same year I came to the US on a H1B), and started my GC process in 2007. The company offered me an pre-approved labor with a 2006 PD, which had a matching requirement w.r.t job description and salary.
During July 2007, i filed for my I-140 and I-485. Subsequently, my I-140 got approved without any issues. Now, given that my priority date is close to being current (2/14/2006), I'm afraid if using a pre-approved labor will have any role to play with my I-485 approval.
And no, I'm not working for a consultant. And I have been with the same employer since 2006.

Well, the first questions are what are your other settings? What mode are you shooting in. What ISO and aperture are you shooting in? Sounds like you may have a shutter speed that is not in line with your ISO and aperture, so you're not "exposing" the sensor.
