I am panning to file I 485 before July 31st. Also I am planning to go on vacation to India around Aug 10th. The trip to India is unavoidable.
Experts please answer the following question:
1) Both me and my wife are on H1 and it has to be stamped. Will I 485 Filing have any adverse impact on the H1 Stamping ?
2) Will leaving the country for vacation without the I 485 receipt have any impact on the I 485 process.

I just came back from India with my H1 visa expired and my wife had a valid H4 visa until May. At the port of entry, Immigration officer told me that since she is on my dependent visa, she had to enter on AP also. so both of us used AP though she had a valid visa

started as an intern with local in the month of march 06 and I was given offer till end of august. but my school official gave me work permit on a semester basis and gave it only for srping 06, which end in may 15th. I couldn't update my CPT status for 1 day for summer 06 and started on 16th may, so the school official has said that i am out of status.Since re-instatement is not possible from school as it was unauthorized work permit. They have advised me to go to home country and attend visa to be eligible for reinstatement. I have grauduated last month with masters of science..
They said they will provide me recommendation letter for me to show to consular officer. Also, I have an MBA admit in same university for spring 2007.
so should i come to new program..if thats the case how to get an emergency appoitment.

i called TSC and after about 10 mins or wait, i was directed to a very nice lady. Who basically told me that they are processing April 30 application adn since mine is august RD, I have about 4 more months before they look at my file. So to answer, they do go by RD and not ND. She also tole me that my name check has been cleared. Its a matter of time now.
I have not seen any updates on my case, since the LUD after FP. I do have a criminal issue, so I anticipate an interview. However, i have forwared all my court docs to them when i applied for 485. some attorneys tell me that interveiw may not even be needed since they have all the court docs. It was for a DWI 8 years ago.

Hi,
I'm GC holder and i've applied for reentry permit and the validity is 2 yrs.
I've been living in INDIA for the past 10 months and now i want to go back to US.
I'd been filing my taxes and all but was not working for any US company for the past 10 months.
Will there be any issues at the POE when i return to US?..Usually POE officer asks the questions like where do you work and what was the reason you went to INDIA..
Is it Ok to tell the officer that i'm not working?

Does any one knows why EB2 India is not approving in comparison to 2006.
As my understanding that USCIS should process application in FIFO and PD.
My PD is Feb 2005 and when I talked to CS he told me that everything is cleared and my case should be approved .
He told me to call after 68 days ( don't know why) if my case is not approved till then.I am seeing peoples with 2006 PD are getting there GC .

Your company's HR/legal should be able to give you an answer on how to reply to the NOF. I think they just have to show that they need you in the location that they put on application. Just make sure that EVERYTHING on applciation pertains to that same location - i.e market wage rates etc etc. If for some reason they do not have experience in these matters, try and get a hold of that NOF and go see a real lawyer. And word to the wise - be prepared to pay a little for the advice that you get. You always pay for what you get- so don't go to some 2-bit lawyer who will charge you $100 for answering questions when you can pay $200-$250 for someone who will give you worthy advice.

My I-140 was processed at the Nebraska center, but my attorney sent the I-485 case to Texas Service center. Since my I-140 was filed at Nebraska, I was expecting my I-485 would be sent Nebraska also.
