I need help for my friend. My Friend's spouse on H4 started to work on EAD. She does not work (or if she gets laid off), will she automatically get her H4 status? If not, what does she need to do to get back on H4. Her husband is on H1.

For the past few months, there have been no green cards available for persons in the employment-based third preference category (EB-3) and long backlogs in the EB-2 category for persons born in India and China. So, with few green cards to grant, why has the USCIS been scheduling interviews for persons in these categories? The short answer is that just because the USCIS cannot grant most EB-3 and EB-2 applicants green cards, the agency can take advantage of the lull in applications for adjustment of status to deny persons with pending applications. I have to file a loan application which requires me to state if I am a Lawful Permanent resident alien or not; and I am not sure if I am, can somebody please clarify if I am a Lawful Permanent resident alien or not if I have a pening I-485 application and I am working on EAD?

as per my knowledge"One should file a new LCA for an H1B petition" if work location changed from one state of US to other state.
Can you please tell me the process and how long will it take for this LCA approval?
After LCA approval, do I have to go for Visa stamping though we have valid visa?

She can't work and you can't apply for work permit. You need to wait for the I-130 approval. Then AFTER you become a U.S. Citizen, she will be able to apply for I-485 Adjustment of Status and only at that time you will be able to apply for work permit. By the way. If the I130 is approved and she goes out of country and then tries to re-enter the U.S. on a B-2 visa, she may be denied entry based on Immigrant Intent, for which B1/B2 visa does not allow. Do some research.

I am currently in INDIA and applying for my H1. I have a couple of questions regarding this:
Back Ground:
1. My husband and myself are applying for H1 B.
2. Company A is sponsoring H1 for my husband and company B is applying for H1 for me.
Q & A:
1. As H1 B is lottery system this time too, we both are applying for H1. Is it possible that, if both of us get H1's, can I still enter into US on H4 status and later convert to H1.

My H1 is valid untill Aug 2010 and AP is pending. My spouse is on EAD and her AP approved. We plan to return back to US from a trip overseas in few weeks from now. Is there any issue if I use my H1 and spouse uses her AP. My AP is pending over 3 months now.
My H1 LCA has two work locations. Primary being NJ and PA secondary. NJ is the port of re-entry. I have letter from my company, which is based out of NJ and a client letter based in PA to support my continual services.
Help appreciated.

What is the impact on GC (485 application) approval for a minor Customs violation at the airport?.
I unintentionally ignored to declare some food that i was bringing and airport customs officer fined me $300.
Will this impact my 485 application, that i will be filing soon?.
Ofcourse, i am going to mention in part 3 b.of application and provide the fine receipt.
Will my GC be denied because of this?.
Please advice.

Dear Core Team,
What is IV's stand on people still stuck in LC backlog in PEBC/DEBC, There are applications pending there since 2001/2002. If this becomes law that I-140 filed after May 2007 will be rejected then the biggest impact will be on such people as even labor is not cleared and even after waiting for so long they will lose everything.

Hello Everybody. I am new to IV. Recently I have filed my wife's I-485 (06/28) after my I-485 approval on 06/18. My lawyer said that he has filed it by using the "Follow to join" benefits. He is saying that he cannot guarantee that USCIS will accept the I-485 since my I-485 is already approved. He said that we just have to wait and see until the receipt notice is issued.
Is anybody else in similar situation? Also does any one know what kind of documentation and cover letter needs to be included for this kind of case? I have asked him if he has included the I-485 approval notice and he said "No".
