Hi,
My labour and I40 are approved and PD is 12/07 for EB2.
My H1B 6th year expires on 10/10
I am thinking of changing companies. The job will be the same.
My questions are:
1) Can I use labour or approved I140 from old company to new company since the job will be the same or does the new company have to go through the entire labour and I140 process again.
2) Since I am already at the end of my fourth year of H1B, is there enough time for the new company to apply for labour and I140 since I believe the GC process should start by beginning of 5th year for H1B extension.
3) Can I use the old company PD for the new labour and I140 or will the PD be new as well.

I have seen references that if there are different I-140 apps approved per family, there is a possibility of going for the 485 stage separately. Also I have seen posts stating that one can go for AOS and the other for CP.
How do you communicate to USCIS that for one you are doing AOS and the other you are doing CP, with reference to the 485 stage? When does this really happen?

my wife and i went to renew our DLs.
i am on EAD and my wife is on AOS(pending 485) and we both have AP valid till feb 2010.
i got a temporary DL and will get 1 year DL in the mail.
my wife got temp DL but will get DL till feb 2010 only (expiration of AP-I94). they wanted to see I-140 or I-130 alongwith I-485.
i emailed flhsmv.gov and they also say that now you must show 140 and dependent names in 485 application which most of us dont have.

I just wandering, how long would it takes get decision in I 485 after FP (background check Cleared)?
I just not make sense to me, that a lot of people file on May and June () are getting approval on September 17, 2007, but latest processing time in NSC for I 485 is December 21, 2006. If that case, my I 485 was filed on July 2, 2007, and it will got approve by the end of this year.
Can someone explain to me how this work or how USCIS make a decision for I 485?

B1 is purely-non-immigrant-intent visa while H1 is dual-intent. Given this, I do not see any harm entering on B1 while you have a valid I-797 presumably starting Oct 1st? So, after returning you can appear for H1 visa stamp and later enter using H1.

Hi, I was wondering how long it is going to take me to get my citizenship. I received my permanent residency when I was 17. I was told I could have gotten my citizenship then but since I married a military personnel I wasn't sure if I was still eligible. Can I get my citizenship now because I received my "green card" under age or would I still have to wait 3 years being married to a U.S Citizen? Can I get my citizenship faster being married to a military personnel?

I know that the EAD card comes directly to the applicant and not to the attorney.
What about RFE on EAD? Does that too come directly to the applicant?

I have a frame on my main Window.xaml, when I click a link on the main Window, a Page.xaml page should appear. Only when I click the link, the page should load, but the page like auto runs without even displaying the main window. The main Window disappears in a flash and the Page.xaml appears. What should I do??

I need to travel out of US urgently because of family emergency.
1) Can I get emergency AP from local/district ofices with supporting documents
2) I saw that I can travel until I get my AP approved.Has any oine denied entry because of they travelled out of US while ap processing is pending.Any experiences..
