I receive the standard IRS letter regarding stimulus rebate.
I took this letter and went to SSA office to apply for a SSN for my wife.
Point number 3 in ss-5 clearly says .....
"If you check "Legal Alien Not Allowed to Work," you must provide a document from a U.S. Federal, State, or local government agency that explains why you need a Social Security number and that you meet all of the requirements for the U.S. government benefit. NOTE: Not all U.S. State or local benefits are acceptable for non-work SSN purposes. Contact SSA to see if your reason qualifies.
If you check "Other," you must provide a document from the U.S. government agency that explains why you need a Social Security number and that you meet all of the requirements for a Federal benefit except for the number."
I believe that IRS letter should be treated as a sufficient reason for need of SSN. BUT THEY DIDN'T ENTERTAIN ANY OF THE FACTS AND DECLINED TO ACCEPT APPLICATION FOR SSN.
As long as you qualify for the stimulus payment, you can get a non-work SSN. You qualify as long as you are in the income levels specified, were a resident of the US in 2007 (substantial presence), and were in the US legally (have a valid visa). If you did not file a tax return, then you cannot apply for the SSN.
As far as the Social Security Act is concerned, the law states that they MUST give you a SSN if you qualify for any federally funded benefit. The question is: Is the Economic Stimulus Payment a federal funded benefit. The information in my original post makes a very strong case that it is.
Please post your experiences here, even if you are denied. Remember, the folks in the local SSA offices are bureaucrats, not lawyers, or judges, so don't expect much cooperation. However, if they deny you application, simply write them a short letter saying that you disagree and that you are requesting a "reconsideration."

I have a pending I-140 since July 2006. Today i lost my sponsor employer and don't know what to do. Can I switch my pending I-140 to another employer? What can i do NOT to lose status? I still have a valid H1B till Augist 2008 but I have travelled on my Advance Parole. Does that mean that my H1B is terminated? Please advise. Thank you.

So far things are looking good, but I have been instructed to not discuss any specifics until the lawyers have reviewed all the information. I should know more next week. I also received a call yesterday from a congressional office, but I was unavailable to take the call. We'll see what happens.

Hey guys
Just received email from CRIS regarding I-485 denial notice for both me and my wife.
I used AC21 after 9 months of filing I-485. My I-140 was approved before even filing I-485 in July fiasco.
My attorney promptly sent AC-21 and G-28 and i did see LUD on my and my wife's I-485 after that.
My previous company informed me sometime ago that they are going to revoke I-140 and probably they did and i am assuming that's what triggered this.
This is certainly a big damm mistake they did even after sending AC-21 docs and G-28.
Uh-oh! Sorry to hear that. But please keep the hope - it may not be all over yet.
Aren't they required to issue an NOID (Notice of Intent to Deny)...check this out under

That sure seems interesting piyushpan. It sure seems to suggest so, but I would not be so sure as it does not say explicitly that you can apply if the priority dates are not current. What it means is that USCIS can not approve the petition, (if a petition has already been filed) unless a immigrant visa is available. Does it mean one can apply even if priority dates are not current ?? I am not so sure yet. But I hope you are right :)

The GOP really messed up big time. Americans are not stupid. They voted the GOP out as a way to show that those not doing a good job would be kicked out.
To the advantage of those wanting amnesty, that may go in their favor. Just remember that you may get your GC, but then that may also mean that America as we know it may be coming to an end. Wait until those 20+ million petition for their relatives and install here their way of life.

Sensenbrenner took this advice verbatim and finally rejected CIR instead of conferencing on modifying it.
I think Congress got the blame later and was termed "Do-Nothing Congress" mainly for this.
It is a bitter lesson for politicians not listening to Senate or President but to Lou.
IMHO, if Congressman Sensenbrenner took CIR to conference (instead of a month-long public hearings) to remove controversial provisions and pass legitimate provisions like the border fence measures, public would have retained the current congress.

I am not indian, I am chinese, and I attended the rally in DC. I am so touched by you brave indian people. while I feel such a shame that we only had much less chinese there. part of the reason is that IV is originally indian club. we got the message but kind of lack the close organization.
anyway, I am also thinking about another rally.
1, it has to be on weekends, so everyone can come
2. it should be in multiple cities, from coast to coast, all major cities.
DC. NYC, chicago, LA, SF, houston, boston. reserach triangle, seattle etc, where professional immigrants lives most.
3. we need to make sure everyone will come, need good personal organization, not just voluntarily, we need personal contact, conversation, meetings ahead, level by level, to build a good "relationship" with each other.

4. we really need to study the illegal immigrant rally last time, how successful they were !!!!
5. honestly, we didn't get much media coverage. shame ! nothing on TV, newspaper frontpage. but--- if we have a huge rally, everyone will have to cover us, pay attention to us. it all depends on us.

I am actually curious about peoples reasoning behind not attending the rally. I don't think anyone should judge people's decisions, but if we can understand why we didn't succeed in tempting you to come, we can learn for next time.
It sounds like you might be considering going to another county or back home? Ironically, if this is true, it highlights perfectly what one of our key messages was at the rally.
You are a poster child of reverse brain drain. The US needs to keep talent, whether it is home grown or imported. By making the process so grueling, people are starting to leave in droves.

See, you are a rational human being and know what to ask for...
But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me. But as long as IV keeps on harping that they represent the plight of legal immigrants (which I am) then I do have the right to ask the question ..."What exactly has IV done?" .

I agree.. and you don't have any right to question the morality of IV or anyone who is contributing.. there are many many threads asking CORE questions about what they are doing and most of them don't have time to read through old posts.. CORE can only answer so many posts a day.. so, the DONOR forum which should be easy for them to manage...

and so are all the personal attacks on the "freeloaders" (like myself ofcourse).
the so called attacks are only when freeloaders DEMAND the answers and then talk about their rights because they are "legal"..
ever heard of the statement "ask not what the country has done for you but ask what you have done for the country ?" - I guess the gist is, because you are born doesn't give you any right to demand.. so, if you replace "legal immigration community" in the above statement, what have we done to the legal immigration community ?? IV is educating people to understand our plights and our DC rally is a good effort in that step - are you there in that rally supporting the community ?? if you are - atleast you are doing someting.. if you think that I am ranting on those who didn't show-up.. may be I am.. thats one opportunity we missed and since then we had electons, change of congress. we may have another rally soon.. when the IV comes up with another effort like that, will you come join me at that rally?

But when i am told that I dont have access to this thread or that thread because I am not a donor...I do have the right to question if this organization actually represents all immigrants or just the donors?? If the motto of IV becomes "Change for fairness and justice (For Donors Only)" then it would make a lot more sense to me. But as long as IV keeps on harping that they represent the plight of legal immigrants (which I am) then I do have the right to ask the question ..."What exactly has IV done?" .
Oops, ok.. I will take that rational thing back.. a lawyer who get paid by you "represents" you and anything he says will be treated as your word. similarly, PR people who get paid and "represents" you - yeah, their statements are counted as yours.. you have a right over their actions that are "representing" you.. you can sue them, fire them etc... now, IV "representing" legal immigration - and you as legal immigration claiming rights over thier action.. are they really the same ?? i don't think both the above "representations" are the same.. enligten me.. how can you claim the right to ask IV anything ..
Asking the question is never the problem, it may make people uncomfortable but I want people (like yourself) who are contributing to at least ask IV before ranting on people like me (who dont contribute) to support the cause...).

Hello All,
I am on H1 Visa and I am planning to go for further studies and converting my H1 to F1.
Now after completing my studies, can I use same H1 petition from Old Quota or I have to apply again in Fresh H1 Quota.
