    Wow!! Do all these Hi Tech companies(including the giant one I work for) not have any teeth in the system. Sanders gets an amendment, but nothing to change the stupid MBS provisions in favor of these companies. Pending further analysis or details not known yet, seems like we can safely join our friends at numbersusa and oppose this bill.

    Section 501 (Rebalancing visa numbers and Z visa allocation) is effective on the first day of the fiscal year subsequent to the fiscal year this bill is enacted.

    Here the fiscal Year is from 1st October to 30th September. If this bill is done within next couple of months, we are talking about 1st October 2007. This is my interpretation.

    Section 502 (Merit based system) is effective from first day of next fiscal year after this bill is enacted, provided it is ateast 270 days away. So I am guessing, we would not see Merit based point system till 1st October 2008.

    Yes but that is when the provisions of the bill come in to effect.
    There is another clause which says "Any pending visa applications filed before the INTRODUCTION of this bill will be counted under the old system". In other words all the I-140s filed after May 15th ( Or June 19th) will have to be re-filed under the merit system if they are not approved and GC received when the Bill is in effect. That Effective date is the one you are refering to. Introduction date is when the bill was added to the senate calander.

    Dear Members,

    As we enter the final 15 days of our advocacy days preparation (http://immigrationvoice.org/forum/showthread.php?goto=newpost&t=1437978) we would like to thank our members that have indicated that they would be coming to DC on June 7 and 8. We also want to thank all State chapters, volunteers and action item leaders that have been helping out with the effort behind the scenes. The massive planning, coordination and implementation cannot happen without the support of each and every member. Help has ranged from phone call campaigns, media campaigns, lawmaker meetings, document preparation, state chapter activities, accommodation initiatives, reaching out to various employers and like minded organizations etc.

    We still have a long way to go in our coordination and implementation. IV membership is working hard to make this event a success. The advocacy day work is being implemented at this time and lawmaker office appointments are being sought. Everyone that has indicated their presence for this event will be contacted personally. We are planning an impressive congressional reception event on June 8, in DC and expect several lawmakers, staffers and leaders of other like minded organizations attending the reception. It will be a great opportunity for IV members to meet these important representatives. There is also going to be a notable Press event on June 8 that we are planning. There are several initiatives being taken that we will be announcing in the days leading up to these events. The event is in itself a huge task that requires planning from getting space for various parts of this event, space for gathering of all IV members (situation room) to transporting all advocacy day material, providing training sessions for members, getting appointments from lawmaker offices, inviting reporters, press release to details like photocopying documents for each meeting, folders and digital advocacy media with IV branding and soft copy of all IV documents as a leave behind in every lawmaker office.

    These emails, letters and communications will help us with more effective and targeted advocacy to help get much needed attention for our issues. All this will need investment from IV and we can do it only if our members support us in this huge task by contributing funds as well as time. We already invest a lot in the advocacy effort we do on regular basis.

    IV effort needs 50 thousand dollars in the next 15 days to make sure we can meet our immediate needs and also make a big impact via this advocacy day events. We can plan more ideas like full page ads in national newspapers if we can have sufficient resources. This event will most certainly bring our issues to the national center stage and help us get much needed immigration relief in the months ahead.

    We are a small grassroots organization with a strong resolve and when we all pool in our energies, intelligence and resources; we can all collectively create wonders. We do not want our limited funds to stop us from going all out. Despite our fulltime jobs, IV core is committed to work harder and we are happy to have the asset of a large IV community to support us in this mammoth task.

    This post is to urge everyone to come forward and help yourself in this short term funding drive. If you have not contributed till now, please consider contributing. If you cannot make it to DC due to personal or professional reasons then do show your admiration for our effort. If you have recently received your green cards, then please consider contributing as a way of celebrating and endorsing our effort. Times are tough for any immigration relief and in tough times we have to work harder to get anything done.     Also we have seen lot of traffic coming to our site why cant we use that also as some "Contributing" scheme like allowing some commercial notes. Some ppl might laugh at me but atleast our every click might be generating 1Cent to our cause.

    Can someone confirm if you can maintain accounts in the US after you leave. That sounds very dumb. I want US to keep my money and they don't want it?

    I understand that after Patriot Act you can't open accounts in US without SSN but I think you should be able to keep your account because that SSN is assigned to you forever.

    I am not sure about effect of patriot act, but some of my friends who left in 2002 era still have accounts here. Another friend left for Banglore but his 401K is still here.

    To pbojja, if you think being concerned about fraud desi companies and highlighting issues we can resolve easily (like English classes) is being disrespectful to one's fellow country men/women, then I must not have put forward my point clearly. I never said that only English speaking skills were required to be a good professional. However, they are important tools for effective communication. Not every desi IT professional in the U.S. is a developer and is in roles which do require good English speaking skills. Anyway, I didn't mean to be disrespectful to anyone.

    To sri1309, I never meant to digress from existing items on IV's agenda. All I am saying is that the backlog might get cleaned up a bit if we are able to assist in weeding out fraud cases.

    stuckinmuck I understand what you say but I dont understand how can you eliminate the problem with so called fraud desi companies , probally they have few hundreed at the most few thousands . In the bigger picture its a bigger issue than few thousand . How can you justify a ROW guy just did masters and working for an year get his GC under EB2 ROW . Its suppose to be employment based not education based ..

    If a company hires a guy with poor English skills , they might have liked some thing else in him ...Not all Indians are same, no single individual represents a country so dont worry about poor communicating Indians around you .

    Know of a few cases from immigration.com where a bunch of envelope PERM filed were pulled in for audit when they saw that a similar case had been filed for lower category in the past. The cases subject to audit were asked to follow through and actually interview the applicants. Losing the job is a real possibility. Think u might still be able to find a few of these if you searchthere.

    That said everything is risky in life.. u don't succeed unless u take risks.

    Question : Why is PERM risky ? I thought that is the only way to get LC now.
    I am thinking of porting to EB2 (10 years + MBA) in US.

    desi9333 thanks for the link. Nice one - even though it covers only Hiring practices, and not opportunities for promotions and progression.

    The "Opportunity" usage has been explained much beyond Hiring in the other laws and related documents. Hence, an employee who subsequently faces discrimination because he/she cannot progress or misses on job advancements due to Visa limit restrictions is certainly being discriminated against.

    Its my view and others can differ. I respect all opinions and am thankful to all because it helps improve my reasoning, mutual respect and tolerance abilities.

    Back to the subject,
    My earlier post on first page this thread has some action items - can anyone here take the lead and convince an attorney to take up the cause?
    My cheque shall be sent as soon as the ball gets rolling.

    The aim is not to convince an attorney. You can file a lawsuit for any reason and fight it. But the question is - Is the case strong enough?

    In this case the case is not strong. IV has access to best attorneys and we have had discussions on this as well. The best way to change country limits discrimination is by changing the law.

    You stand a better chance of getting it through your kids if they are citizens than getting it through EB3. There are a few options to get green card faster. Canada is not one of them.
    1. Get a Ph.D, get a job in a univ and apply in EB-1.
    2. Get a MBA and get a management job and apply in EB-1.
    3. Become a religious worker in some temple and apply in the religious worker category.

    PhD is no trivial thing. One does a phd only if one is truly motivated.
    Plus PhD doesn't guarantee EB1 either.

    Since 2001 downturn PhD graduates are having a hard time getting faculty positions
    as education budgets haven't increased much and therefore faculty positions are very hard to get unless you are from a top school like UIUC, Stanford etc.

    You will have to do 1-2 years of post doc at 30K per annum salary to land a
    faculty position.

    So you are looking at 6 (phd) years + 2 (post doc)years to land a job as faculty
    and after that it might take1 years to get GC.

    Living on 6 years of 18K per annum salary(Phd) + 2 years of 30K per annum salary (post doc) is no easy.

    You are better off working on H1B . At least you will earn more and have a better life.

    Can we all just "grow up" and get along ? I think only then we have "one voice"

    sorry buddy, that's too much to ask from this group of educated illiterates, who talk of king and know that someone with the name chanakya existed in the past, but don't understand the concept of "growing up".

    Every morning I get up, go to work, and logon to these forums every now and then. And everyday I see someone venting out at the only set of folks who are actually trying to do something about our issues. We know for fact that there is no other group who is working to fix green card backlog. But almost everyone who visits these forums never miss a chance to throw things at folks trying to do something.

    If it was me, I would said - screw you educated illiterates because you don't deserve anything.

    But hey, who am I to say this to the elites with highly blotted ego.

    For few days I saw a thread asking this group to do something about the aged out kids of legal immigrants. I saw that thread for over a week and was tempted to support that initiative. And then, 3-4 days back, I saw a request for media interview from anyone who is facing "aged out" issue. And you know how may people showed up for the media interview, ZERO. There was not a soul on this forum willing to speak up for their own issues, but some of the folks in that thread wouldn't stop blaming others for not doing enough. How do I know all this, because I read those posts.

    So in the end, we want someone to spoon feed us, do baby siting over us, while we continue to vomit and throw-up on that group of people every few hours. Yes, your question is legitimate - Can we all just "grow up"???? NO

    as far as I know , you need transfer it again


    Gurus please advise,

    I have a H1b with Company A. It expires in Nov 08.
    A couple of months ago I joined company B and they transferred my H1B.
    Now if I want to go back to Company A, do I need to transfer my H1B again?

    Company A has not cancelled my H1 and I am in good terms with them.

    I don�t like CIR from the beginning because it is a compromise of four parts which are illegal, high skilled, family based, and border tightening. Obviously we are the smallest group in CIR so our interests were barely considered but we were sacrificed whenever they needed to compromise. So I believe we will live after CIR is dead! Why so sure? It is because the provisions for EB and H1 have to be considered in some way. It was a joke to the lawmakers that the H1 cap was reached in the first several hours. Some lawmaker criticized the abuse of the quota. But it also reflected the fact that there was the shortage of the quota because the shortage invoked a strong desire which led to abuse of the quota.

    IV core team,

    Whats the plan of action given that CIR is dead for now?The best would be to try to attach a small relief like S.1932 in 2005 to some budget appropriations bill.Even SKIL will gather lot of unnecessary attention.Did we spend all our funding on this lost cause and need to contribute again?If so its better to start now as IV got lot of new users.

    As I said my numbers are not accurate, there are lot of visas unused since retrogression, we need to take look at this and spent more time researching and contacting right organization

    But still the good news is everyone would be able to get their EADs and escape from the clutches of H-1B renewals and restrictions of remaining with the same employer etc. It's freedom to work anywhere! Doesn't matter when actually the I485 gets approved, until then you're free of H-1B tension at least. This is a big leap forward.

    I would bet my chances with H1B rather than EAD. I myself is on EAD since 3 years and know the issues in getting the renewal on time. EAD will help those spouses who are on H4 to work but the circus will continue until the final approval is received.
