Not sure what you mean by this...
I never said I agreed with country base quotas for EB. However; lawmakers, etc. are not stupid people. We have to try to understand why they are there and why it is not being changed. We have to understand the symptoms before you can find the cure.
Your argument is that the country quotas help limit nepotism and discrimination based on national origin. However, this is already prohibited under DOL rules if you look at form ETA-750A. Therefore, if this is happening, it means there is a failure in the labor certification system to prevent this type of discrimination. Also, nepotism is not all bad as the Clintons and Bushes have been demonstrating :D.
The country quota owes its origin and sustenance to deep national insecurities around race. It will change eventually as the makeup of the nation changes over time. In the short term we will see movement as the UK bumps up against the 7% limit.

Now thats unfair .... you are just using one part of the quote to distort the entire post ... The discussion and context of that statement was always on categories.... and was using that sentence as an example on categories...
The assumption was that readers would understand categories over individual qualifications/countries of origin in this context
If you destroy the context in which a statement is made it makes the entire post "look" bad and is disingenuous
Here is my entire post
"It does make sense that the overflow numbers are given to higher preference categories in single state oversubscribed countries. When you think about it, will that not be the most beneficial to United States? Who would you prefer .... and Unskilled professional from a ROW category or a skilled worker from an Oversubscribed country. I would gather it would make more sense to give the opportunity to the higher skilled since the benefit to US will be higher"
Your arugment would hold if there were no country limits.

I dont think it is 9,800 each. I think it is 9,800 combined - 7% of 140K. To that extent the 21500 number in my earlier post stands revised down to 17,700.
It shouldnt cross 7% of 140k which is equal to 9,800 for each category. Not combined.

Guys,
Improving your own skills by doing Double MBA would not be gandhigiri.
A course in history will teach us what Gandhi did for rights of Indians in South Africa, who were oppressed and had to pay more taxes than anyone else. He fought for those people. If we could even manage to perform a percentile of that , we maybe able to get our community's problems resolved. I am sure the people working in farms in SA had no rights and were treated like slaves, we however, are in much better position and different times than the late 19th century. Not sure we can get a Gandhi to lead us, but if we strive for Unity among the Retrogressed community we can defintely improve our situation.

You came here 6 years ago and applied for your GC only in 2010. Didnt you find an employer who would file one for you. And you also know if your GC gets screwed for some reason, then you are out of the US also.
Looks like something is missing, Dear.
6 years ago, in 2004 (2010 minus 6 years), there was no retrogression. And you didnt apply though you had an option. Very very funny.
Tell me, what are the facts.
I came in 2005 and was eligible in 2006 for EB3 as per company's policy. There was huge retrogression then and I was hoping EB2 would be better for GC and career. Anyway, that's not the point.
One thing I like is that people are acknowledging the porting is a loophole and plan to use it anyway since it suits them.

I just found out that I will not be getting the stimulus as my wife is cannot get a SSN. In addition, we will not be getting stimulus amount for our American born daughter.
We have been here for a year and a half and while there are some benefits to being in America, my wife and I are trying hard to understand why we moved here from Canada (saving taxes is no benefit when compared to having to deal with ignorance all around). My being here is benefiting an American company (which did not have the expertise that I brought to them and this country) and thereby this country.
If I were to leave the company, a number of people would lose their jobs and I would take my expertise somewhere else.....
Is it true that almost everything done in America is poorly planned and lacks foresight and common sense? Our experience here to date is giving us this impression.....
I would be interested in joining with others against the IDIOTS who don't understand who is benefitting this country.

I guess there is very little follow-up on this issue.
That doesn't mean nothing is being done. I am continuing to do a lot of work on this, but there is nothing new to post right now.
To date I have been able to get every newspaper in the country to do stories on this, as well as three scathing editorials in the NY Times, LA Times, and Mercury News, all of which slammed the government for its action.
I have worked with the staff of a member of Congress to ensure that house representatives were aware of the issue.
As a result, the house of representatives unanimously passed the HEART Act giving stimulus payments to affected soldiers overseas.
I have been able to get an important legal organization to review and research the topic for possible litigation.
I would love to go over the legal details with you, but it is not prudent to give too much detail here right now.
And finally, I have been corresponding with immigrants like you providing advice and updates on the situation.
I am not sure what more you expect.

com 'on. H4 process is known as Dependent Visa. You knew this before getting your "Babli" to the US. Let H4 prove the Credentials and Get H1 and then start seeing "Green".
Nobody asked you to get married :)[/QUOTE]
I really take exception to that comment. I have 2 Masters degrees (one from the US)...unfortunately they are not in Engineering/Science. What people don't seem to realize is that it is extemely difficult to get an H1-B if you are from a Humanities/Liberal Arts background. I'm a teacher and there are jobs in my field...the only problem is that school districts/community colleges/universities are unwilling to sponsor H1-Bs!

There is no suprise on it. There may be 3 reasons for that
1. It is deviating from grand bargain. Some republicans accepted CIR based on the condition that point system needs to be introduced. Cantwell amendment invalidates that in high skilled category
2. Anything unlimited is tough to convince Senators as immigration concept is based on shortage of workers. Cantwell amendment has many exemptions for H1b and GC
3. This has provisions which will make Durbin bill almost ineffective
If some compromise is suggested in those three points then there is some possiblity. Otherwise it is going to be tough
The word on the street is that the Cantwell amendment is not a part of the list of amendments that are currently floating around in Senate offices. There are 20 of them.
Even Bernie Sanders has one more coming (Yes, it is related to H1B). But Cantwell amendment is not there in the list of 20.
Here is the list of 20 amendments floating around in the Senate:
Democratic Amendments
1199 Dodd ---- Family parent visas
1313 Webb ---- Community ties for Zs
1236 Baucus-Tester ---- Strike all reference to REAL ID
1332 Sanders ---- Employers to certify no mass layoff
1344 Byrd ---- Border security immigration fee
1317 Menendez ---- Increased family points in merit system
1340 Brown ---- Employers post job at state agency
1468 McCaskill ---- Repeat violators who hire undocumented workers
1486 Levin ---- Iraqi religious minority refugees
1386 Leahy ---- Refugee Scholars (may instead be 1289 on EB-5 investors)
____ Schumer ---- Tamper-proof biometric social security card (no language yet)
1198 Boxer ---- Reducing Y visa cap by number of Y workers who overstay
Republican Amendments
1161 Alexander ---- Oath of allegiance for naturalization (may move to managers package)
1255 Bond ---- Prohibits green cards for Z holders
1473 Coleman ---- information sharing/sanctuary cities (Coleman is redrafting, new language not available)
1335/1258 Domenici ---- Federal judgeship increase (redrafting)
1490 Ensign ---- Preclusion of social security benefits
1465 Graham ---- Enforcement, plus other potential agreed upon amendments folded in (redrafting, content not clear)
1441 Grassley-Baucus Obama ---- Strike and replace Title III (small changes possible)
1440 Hutchison ---- Touchback/strike and replace title vi (redrafting)
1174 Thune ---- Probationary legal status triggers
1318 Chambliss ---- Totalization agreement
1282 Isakson ---- Preemption/Home Depot (redrafting)
------ Graham Criminal penalties/mandatory minimums for overstays

Simply amazing ...
have you guys lost the ability to think and read...
It is USCIS that decides the categories and it is they who say that EB1 is more skilled and valuable than other categories
Again ... like I said in my post .... It is NOT NOT individual's qualifications or Country that matters, it is the JOB descr they do that decides the EB category. IF USCIS places more value on EB1 than EB2/EB3 category jobs that is not my problem .... but thats the way it is... and that was my point .... if the value placed on the job is higher that job...
If things make you sick .... there is a fix for it .... go to a doctor ...
But truly... I do believe you are sick, inability to coherently digest a discussion and think is a serious anomaly and you should get it checked out...
What the hell do u mean?
How many people in EB2 do a different job from EB3?
Most of the people in EB2 almost do the same programmer job. I have been in this country for a long time. I have friends who have done their MS from colleges like stanford, santa barbara. I don't see a difference in their role. I have more than 10 yrs of exp. I have worked in different roles too.
For jerks like u to come and talk abt people in EB3 being unskilled, makes me sick.
Shut the f*** up

Hi,
How can one know if ones employer has withdrawn/cancelled ones H1B visa? Apart from asking the employer, if one uses the EAC # ans checks the status on www.uscis.gov, will it be reflected over there?

You guys are doing a good job. My question is.... will 252 contributions / month be enough to support the new initiative??
Guys can each one of us get one more member this month by calling few friends ????????????????????????????????????????
Is there a way we can have access to the tel no. of non contributing members ?????????????????
The target is 1000. IV core group is not asking for funds now because we have done all we could to make our case and we have reached a ceiling. Now, it has to come from the heart of the members and if they feel we are doing the right thing they will contribute. We had all kinds of nasty posts whenever we /members started asking for contributions. Yes it will help when you call your friends. No we dont have phone numbers. Only few people put their phone numbers in their profiles. most register annonymously and a lot of nasty posts come from such members. Despite repeated requests most members have not updated their profile with contact information.
