I don't know how to start a new post so place here....
I was working on a H1B.
Husband - who is the premary person applied for Green card. When his priority date was current he applied for I-485 for both of us.
After getting my EAD I started working on EAD for 1 month and got the paystubs for past one month. Now looking for new job.
Which status Am I - H1B or EAD...:confused:
Now If I am on EAD can I take a break for 3 months before the next job offer.

Actually, it was published in every major paper in the US, as well as in India, China, Canada, and a number of other countries. It was this broad coverage that led to the New York Times editorial. My case was similar as yours. USCIS just sent a Denial on my 485 without sending a NOID in May. If 180 days have been passed on your 140 approval, then you are safe. If your employer revoked your 140 within 180 days, then you have a problem. Normally desi employers revoke 140 because of Ability to Pay issue etc. especially when you move to a different company. Good thing is that you still have your H-1 to fall back on.
Anyways, My case was reopened within 2-3 weeks after we filed MTR and got a copy of the decision. Filed EAD and AP renewal this July.Got EAD and turns out they denied my AP based on the previous 485 denial in May and didnt even look that they have reopened my case in June. So fighting with USCIS Nebraska center on that right now ! Too infopass and the Immigration Officer is supposed get the information corrected on my file and get my file reopened for AP. Really dont think they look into their own notes or paper work even when issuing denials.

I am also worried. I called my attorneys office to inform them but of course like always he is in a meeting. I am sure this was an error but I am hoping its not call me optimistic but I like the smell of green card :)
I am sure this has happened to others too, but most people will not leak out the news :).
1) If you have dependants who have applied, then they may not get approvals.
2) This was a problem for someone, whose case was posted on Murthy.com. His case was approved when the PD was not current, and he had been waiting to apply for his wife's 485. But since the dates were not current, he could not apply for her 485. So He had to call up CIS and notify them of their mistake.
So is it safe to just get the card and use it? it depends on your luck. They may never discover their mistake or they might. So check with your lawyer.
I am sure this has happened to others too, but most people will not leak out the news :).

why didnt ur friend apply for MBA in canada?....i think a lot of people have misconceptions and pre-conceived notions about canada.......they think of US as the best and canada does not even figure in their list of options......i have got fooled once into h1b to US unaware of the broken immigration system.......wont happen again......i believe the ones in US on h1b visa from india should spread the word about the pathetic EB 2/EB3 india scenario so that no one else gets lured into US by h1b candy

You will be fine as per the rules. Just make sure you hire a very capable and reputed attorney, just in case the one you have isnt the best. I faced something like this, with 140, and went to one of the big firms we quote many times here and the case was approved with an MTR in just 20 days.. DOnt loose heart. But make sure you do the documentation whatever is needed and make no compromises there. Provide more thats relevant.

I did not find this invalid. But the NSC update from last year also doenst say as how long it was valid. We really need to talk to an attorney.
As for me, I am going to file my I 485 by July 31st if I dont receive the reciept notice from USCIS. We can just show other proofs that it was more than 15 days that we filed our I 140.
In this case we dont know till when the update is valid. so it can't b said that it is invalid also.
so I am planning to wait till Aug 10 to get the receipt notice, otherwise i ll fle myself with the fedex tracking number and the letter from USCIS about the labor approval.

I had H1 from company A with dates from 2005 to 2008. after working with Company A for one year, I moved to company B in 2006 (04/10/2006) and My H1 transfer with Company B is still pending. I got H1 RFE query from CSC last month with biglist of documents. Now I got news that CSC denied couple of H1s it seems recently..So can I ask company C to file H1 transfer petition so that even if CSC denies my H1 from Company B, I can maintain my legal H1 status. Or Can I ask Company B to file another H1 transfer petition at Vermont service center (because my company is in that region).

Once you start working on EAD you are no more on H1B. Your future employer can apply for H1B for you. Your previous H1B is automatically 'abandoned' as you used EAD

A couple of months ago, when I realised that my son who is on H4 with ITIN was not qualified for $300 under the stimulus program, I felt bad, not really for the 300 bucks. Instead, I felt strongly that my son is discriminated for his immigration status for which he has no control at all, he is only 12 years old. As father of 3 (two youngsters born in US), I love them all, equally, regardless of immigraton status. Certainly, this stimulus program does not.
As such, I contacted VA chapter of ALCU, who replied that there are just so many injustice in the world, and they could not help anything, however, they offered paid service if I like to go further. I did not bother to contact them anymore.
I received the payment under the program a couple of days ago. I did not tell my son that he did not get anything, since I do not want to make him upset or plant a seed of badwill in the mind of my son.
Thank you for great job to fight for your right, and the right of those on the same boat. I am with you.

Why don't you send PM to IV core members and discuss the issue with them? This may be your starting point. Discuss with them about IVs position on this issue and how soon they may take up this issue with high priority. Also they may advice you about the right persons (senators/Congressmen) to contact etc.
I advice do not use this forum to communicate with IV core team as you already know very well that there are many people who are already scared to lose their chance if your labor is approved.

Usually this is when you are applying via a marriage based case, or are in the final green card process and it has reached portability. There is information that law firms cannot release to you as some information requested belongs to the client, and they must receive authorization from the client. Yes, I used to work for Fragomen, before anyone wants to assume anything. I was a paralegal and worked hard for every case that was given into my hands. I specialized in the green card process and made sure I responded to every foreign national as quickly as I can. Please understand that paralegals and legal assistants are subject to the attorneys they work for. Therefore, some questions you may ask require an attorney to respond, and the paralegal or legal assistant's delay may be in trying to get the answer you require. I know not all Fragomen offices work the same. Not all will respond to you in the same manner. Some may be worse than others. So if you are going to defame Fragomen, would you please try to specify which office you are referring to?
